How long can my chapter 7 bankruptcy case last before it's discharged?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Chapter 7s normally run through relatively quickly. On the other hand there are exceptions and I must refer you back to your bankruptcy attorney unless you would desire to bring in the entire file, have it reviewed, and received opinion. Obviously a fee would be charged for such services.

Am I liable for my daughter's debts?

Mark Stuart Cherry
Answered by attorney Mark Stuart Cherry (Unclaimed Profile)
Bankruptcy lawyer at Mark S. Cherry, Attorney at Law, PC
Being on the bank account would not make you liable, but make sure you do not co-mingle your funds. Also, you should be a signatory only. Liability for her medical debts would be based on guarantees you sign with the providers or certain statutes that hold certain people responsible.

I am owed back child support, if my spouse filed Chapter 13 does it affect the order that's already in place?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
If you are in NJ, you should get counsel. You have to protect your rights to the Child Support which is Priority over General Unsecured Creditors. I handle this type of case quite often.
