The simple answer to your question is not much. Even if you could prove malpractice, that is, the doctor used substandard care with your son, the case would not be worth pursuing. In order to establish negligence, you would need to hire a medical expert that would cost thousands of dollars. You would have a 2 to 3 year litigation process that would be very costly. In the end, your son's pain and suffering would not be worth the cost of a lawsuit. Unfortunately, you must use an economic analysis with this and it just doesn't make sense for you to spend the time and money. I wish I had better news for you, and I am sorry to hear about your son's suffering.

Yes. You can sue the person who was driving. The owner's insurance will likely cover the damage up to the limits of liability coverage, although they may try to deny coverage if there is a clause in the insurance policy against allowing unlicensed drivers to use the vehicle. If there is no insurance coverage, you should have uninsured coverage that will cover damages up to your policy limits. You can sue the owner for negligently entrusting the vehicle to the unlicensed driver if you can show the owner had reason to believe the unlicensed driver was unfit to drive. Not having a license, in of itself, may not be enough to prove this (I would have to do additional legal research on this issue to determine if the courts have addressed whether entrusting a vehicle to an unlicensed driver is enough to establish negligent entrustment).

It simply means that their investigation reveals that their insured was sufficiently at fault to subject them to a negative finding on liability at trial. A Plaintiff still has the burden to prove that the claimed injury was related to the accident and that the treatment for the injury was reasonable and customary. Nevertheless, it is a good place to start.
