These include:• Lack of capacity — This ground alleges that the testator was not of sound mind at the time the will or trust was executed.• Undue influence — Documents might be invalid if a person with access to and power over the testator used emotional manipulation to gain special consideration in the will or trust.• Fraud — This ground alleges the testator was deceived about the contents of the documents at the time of execution.• Void for vagueness — This ground asserts that the terms of a will or trust are open to conflicting interpretations and it is impossible to know which interpretation is correct. A challenger can prevent part or all of the will from being implemented.Many probate and trust disputes stem from suspicions that a particular individual took advantage of the declining health or dementia of the deceased to insinuate himself into the will to the detriment of the rightful heirs. The court looks very harshly on this type of elder exploitation. However, it is important to note that disappointment is not grounds for an heir to challenge a will or trust. The fiduciary must perform at a professional standard so that assets are not lost due to waste, fraud, misallocation or mismanagement. We were referred to Attorney Sermons via a legal service we purchased for a criminal case. I would recommend him to anyone as he is thorough and most importantly thoughtful and understanding. He remained in contact with us throughout his representation and was 100% invested. He was also willing to work with us financially due to circumstances unrelated to the case he was handling. I consulted and retained Markus Sermons on a Family Law matter and I could not have been happier with his legal representation. Mr. Sermons is a "one of a kind" attorney. There are very few attorneys like him in this field. He is always easily accessible, responsive and extremely responsible. He has helped me throughout different chapters of my life, including my son's adoption and estate planning. We always get what we ask for and if for some reason we cannot, he always sets the right expectations. I highly recommend him to anyone.

U scheduled an intake for a simple name change, the guy who got on the phone with me had no personality, clearly had not read my intake form, seemed to have cared less about taking my call, asked me "why didn't I just get married" if I wanted to change my name and proceeded to quote me a RIDICULOUS price to do it. I'm a former paralegal who well knows the process, I just don't have time to do it myself at present but after being quoted $3,000 plus costs for a simple name change that takes all of 35 minutes to fill out and $400 to file I'll be doing it myself. I even told him, I have all the required copies of documentation that would be needed. Filing simple paperwork that is already completed and one court appearance should not be $3,000. I'm sure this is a fine firm based on all the positive reviews which is why I chose to call and schedule an appointment but they should really care who takes intake calls and makes the first impression for potential clients.

I hired Mr. Sermons to represent me to be my sons gradian of his estate when his mother died this year. After dragging it out for 5 months he then tried to charge me again to represent me for the same thing. To try to take advantage of someone who is a single father of 3 dealing with the death of their mother is beyond deplorable. Stay away from this office at all cost. They are why attorneys get a bad name. Only in it for the money. I have filled a Florida Bar Complaint against Mr. Sermons law firm.
