Applying for driver's license while I485

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The processing of an I-485 application generally does not bring the privilege of a driver’s license. For that, our understanding for New Jersey as well as for most states is that you would have to either have the I-485 approved or apply for and have approved an employment authorization card. Such an application is on form I-765 and can be filed concurrently with the I-485 application or at any time thereafter. Due to the limitations of the Lawyers.com Forums, Alan Lee & Arthur Lee, Esqs.’ (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. No Attorney/Client relationship is or shall be construed to be created hereby. The information provided herein by the Firm is general, and requires that the poster obtain specific legal advice from an attorney. The poster shall not rely upon the information provided herein as legal advice nor as the basis for making any decisions of legal consequence.

Could you advice if still i can switch the employer after visa expires?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
Your H-1B classification is still good as long as you are still employed by the Petitioner and you are abiding by the terms of the H-1B. Even though the visa expires, the status does not. The status is good as long as the I-94 is valid. As long as you are in status in the U.S. you can switch H-1B employers. You can use portability or you can process the case (by normal methods or by premium processing) and move to a new H-1B employer.

What is the correct filing location for I-765/I-131 with MSC receipt and employment-based I-485?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
For I-131/ I-765 applications filed after the I-485 has been filed, the proper address depends upon your home address as designated in the USCIS lockbox filing locations chart. The chart goes by your location rather than the three letter prefix of your receipt number.
