Although your husband may end up in removal proceedings, if he is a Lawful Permanent Resident he will not be removed based on a conviction for disorderly conduct alone. He will likely have a defense available and may not be charged. As a naturalized citizen you do not have to worry. I would recommend that you speak with a competent immigration lawyer sooner than later to better understand his options.

Hello. Yes, you may file to remove your conditions without your husband. You must be divorced for them to approve and you must provide ample documentation that the marriage was real and bona fide. In addition, if there was abuse you can file under that option.

You can apply for your green card without having to leave the US. This is the case even if you overstay your student visa. The green card process takes about 90 days from start to finish (if done correctly). You should not leave the US during this process.
