If you were not convicted of certain sex crimes involving minors, you can legally file the petition for her. The problem is that depending on how long you will stay in prison and if you can prove your relationship with her is bona fide, you may have hard time to convince the USCIS your marriage is real. You also need to sponsor her and in your case, you will need co-sponsor as you will be in prison and you will not have enough income. You better consult with immigration lawyer soon.

The copies are fine. If you do not have a lot of evidence of cohabitation and co-mingling of funds, consider getting affidavits from neighbors, friends or co-workers that have first hand knowledge of your marriage.

It is unclear from your facts, but it seems that you were removed or deported from the U.S.. While you may have only overstayed your I-94 by 4 weeks, if you were deported or removed than you are inadmissible to the U.S. for 10 years. The 10 years began to run when you left the U.S. and you cannot return to the U.S. any sooner unless you apply for a new visa and are granted a waiver.
