How long does humanitarian parole take?

Reza Athari
Answered by attorney Reza Athari (Unclaimed Profile)
Immigration lawyer at Reza Athari & Associates, PLLC
I am not aware of any "humanitarian parole" for someone who has been deported 3 months ago. The standard of humanitarian parole is very high and CIS must weigh positive and negatives of the case, the government interest and policies, etc. etc. and I have seen it hardly to be granted. When you say fiancé, I assume that you are going to get married. And if so, maybe your lawyer should think about other avenues to bring your fiancé back.

What are the steps do I take to marry my fiancé in Argentina?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
She should check with local authorities the local requirements and you need to collect documents here (maybe your birth certificate or a note that you are free to marry, etc); you get married and then you file I 130 petition, after that USCIS, when it is approved will send your case to NVC, NVC will send it to the consulate, and she will be applying for a CR1 visa. Good luck!

Can we still be together during the I130 application?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)

*K3 Petition* Since you are already married and your spouse is outside the U.S., it would be necessary to apply for the K-3 Visa. The particular visa is considerably faster than the Consulate Processing needed to bring your spouse in as a Lawful Permanent Resident. Here, we would apply for the K-3 Visa which would take about 6 months. After, your spouse is in the U.S., the Adjustment of Status package can be filed.
