Do I have to start at the begining of the immigration process?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
You can request a transportation letter from the US Embassy in London upon showing of your LPR status. You may have a problem to show that you have not abandoned your LPR status as you were out of the US for 4 years. If you are determined to have abandoned your LPR, your parents will have to to apply for you again. You will not get any special treatment just because you were once an LPR.

Case is under review

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Domestic violence convictions can bring much trouble to immigration cases, but it is difficult to state anything one way or the other about your husband's situation as there are not enough facts to make an assessment. However, the fact that the interviewing officer said that she did not care about that case and that everything was going to be fine is a good indication that it may not be a determining factor. It is standard practice for any case involving crimes to be reviewed by a supervisor before final adjudication. How do I obtain a replacement for lost green card?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you moved back to Canada in 1995 with no visits or sporadic visits to the U. S. since then, you would have lost your green card long ago. You would probably have to start the process all over again of immigrating to the States. If your children are U. S. citizens and over the age of 21, they could conceivably petition for your immigration. If they were 18 years or older at the time that you married with your 2nd wife, however, they would not be able to petition for her. In that situation, you would have to immigrate first and sponsor your wife under the F-2A category for spouses of lawful permanent residents. The backlog before she could enter the States with permanent residence is approximately 2-3 years.
