Can my son petition me if my passport had expired for more than 2 years and I can't renew my passport due to a bankruptcy case in my home country?

Are you in the US? Your son can petition for you, but if you are outside the US, you will not be able to receive a visa without a valid passport.

This is all very complicated and I'd suggest using a board certified immigration lawyer. You can review the complicated forms and instructions and look for forms I-130,485,864, and G-325A. And, yes, you must be married in order to sponsor your wife and her child.

I'm a U.S. Citizen and i want to bring my wife and my stepchild to live with me. Can i apply for a AOS if they are admitted to the US under a VWP?

Answered by attorney Stephen Arnold Black

Dounbtful, because of the issue of  intent.. The Visa waiver program is a temporary entry permit. You state that Your wife and stepchild are coming here to live with you, not to visit, so the Port of Entry officer would be concerened about this. You should discuss all your options with counsel to assist you.
