This gets complicated in that the consular official must 'presume immigrant intent' when reviewing a non-immigrant visa petition. If your brother can prove to the satisfaction of the consular official that he does not have immigrant intent, then he may be issued a visitor visa. The decision cannot be appealed. He may try to apply in six months for another visitor visa. Some people, who have relatives in the U. S., and really want to immigrant, should consider other dual intent visa options like an H1-b visa, when they have the proper background and employer. If you have any further questions about the process, and how you may help, then I strongly recommend an appointment with a competent and experienced immigration attorney before you do anything.

Your mother unfortunately cannot be waived for the English test as that is only available for persons who have held the green card for 15 years and are 55 years of age or 50 years and held the green card for 20 years. We presume you are a USC. If so, once you are married then You will first have to file a Petition for an Immigrant family member on Form I-130. You can also file for an Adjustment of Status in the U.S. on Form I-485 if your spouse is in the U.S. (and entered with inspection). Alternatively, your family member may be able to process for the green card at the U.S. Consulate. Please note that the process for sponsoring a member of the family has many nuances and we encourage you to consider hiring a qualified immigration lawyer or attorney with regard to this matter. One particular nuance has to do with the planning or filing of the Affidavit of Support Form and package.
