Green-card Holder Filing I-130 and I-485

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you are sponsoring your wife under your green card status, the priority date of the I-130 petition must be current for visa availability and she must be in valid nonimmigrant status to be eligible for the I-485 to be filed. If not, she can either return or wait for you to become a U. S. citizen. Upon your citizenship, her category would change to immediate relative, a preference which is always available, and her overstay would not prevent her from filing an acceptable I-485 application. What form do I need to fill out to notify the government regarding change of employer for my green card?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
The response to your question is quite complicated. It depends upon how the green card was done and in what part of the process it is in. There may not even be a "form" available for this type of process. Also, there may be many important and ancillary issues surrounding a change in your employment.

What can I do if I was sent to ICE custody and I’m facing deportation now for a DUI?

Answered by attorney Peter S Kollory (Unclaimed Profile)
Immigration lawyer at The Law Offices of Peter S. Kollory
The safest way to avoid removal is to have DUI charges dismissed. In order to do that you have to plead not guilty and try the case. Meanwhile seek continuance in removal hearing pending outcome of DUI case. You need an attorney with these areas of practice, or a small full service firm that can also handle immigration.
