What happens next after the affidavit and is this when it gets forwarded to consulate for my interview?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Besides the affidavit of support, the applicant also needs to submit an immigrant visa application and his or her civil documents (copy of passport, original birth certificate, original marriage certificate, original al police certificate, and 2 photos). After the NVC has received everything, the NVC will schedule the interview appointment within a few weeks.

What can I do if my wife wants a divorce and I only have temporary residency?

Answered by attorney Patrick Lee Jarrett (Unclaimed Profile)
Immigration lawyer at Jarrett & Price, LLC
First, I am sorry to hear you are going through this difficulty. Under the two-year conditional residency card, you and your wife must jointly file the I-751 petition to remove conditions. However, if the marriage ends in divorce, you will need to ask for a waiver of the joint-filing requirement. This can be done, but there are circumstances that you need to prepare for and understand. You should speak with an immigration attorney regarding your case to develop a strategy for moving forward. Best wishes.

After divorce can I still get my permant green card?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Individuals who can show that they have had a bona fide marriage are able to remove the conditional basis of their green cards by themselves. In your case, having a baby and house together would be sufficient to prove a bona fide marriage. You can file the form I-751 at any time after you obtain a divorce.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
