As long as a person has a valid, unexpired visa to enter the USA, they will normally be re-admitted, as long as they are not otherwise excludable. Sometimes, H-1B workers will bring along proof of current employment like recent pay stubs, last year's W-2 etc.

Call them. Usually they're looking for someone because they plan to arrest the person and take him into custody. We represent people in dealing with that situation and to help try to avoid arrest.

Many U.S. Courts have found that the immigration service cannot require you to live together as such may raise serious constitutional concerns. I have done many of these applications and cited these cases to get them approved. It is possible to get a green card this way, but you need to have a lot of evidence of the bona fides of the marriage.
