Do I HAVE TO covert from F1 to F3 or it is up to me?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Obtaining a green card under the F-1 category for single sons or daughters over the age of 21 of US citizens when you no longer fall within that category but within the F-3 for married sons or daughters of US citizens constitutes an act of fraud. A permanent residence attained in that way is revocable. I suggest that you inform the National Visa Center of the change in your circumstance. Is there any type of visa that has validity over 1 year?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
The Consulate is allowed to issue a B-1/B-2 visa for up to ten years. However this is at their discretion. If they do not want to issue it for that long, then you will be stuck with renewing each year.
