Immigration lawyer at Law Offices of Alan R. Diamante APLC
There is always a risk. You never know when the officer will probe you when you arrive at the port. You have to tell the truth. If he does not ask, he can let you in.

Can I fix papers for my dad he had a work permit back in the day and he took the citizenship test twice but he did not pass it. Can he apply again?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you apply for your father and he files for an I-485 adjustment of status application, you and he will have to try as best you can to convince USCIS that he entered the US legally. For adjustment of status purposes, an applicant must show that he or she has been inspected and admitted or paroled into the US or that he or she qualifies through §245(i) under which he or she must have been the beneficiary of a labor certification application or immigrant visa petition by April 30, 2001 and have been physically in the US on 12/21/20 (latest iteration of §245(i). Will marriage stop my boyfriend from being deported?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
Perhaps, but more information is needed. It is unclear if marriage, alone, will have an impact. However, if his attorney is negotiating with prosecutors, then I strongly recommend that your boyfriend hire a competent and experienced immigration attorney now before a final trial or plea. His criminal attorney may not understand the legal details that can lead to a less significant conviction. Sometimes, sentencing modifications can make a difference.
