I am familiar with a procedure for active duty personnel that allows spouses to obtain their green card from within the US without leaving. This is called Parole in Place. However, I am not certain if spouses of veterans will apply for this program. More research is required.

If your wife overstayed her authorization by at least 6 months, she could be subject to what's called the 3- or 10-year bar for unlawful presence. In such a case, she will be deemed inadmissible due to her past immigration violation but she can file for a waiver of the inadmissibility on Form I-601 by proving extreme hardship to you or her parents.

How can I help my friend who wanted to come to US from the Philippines?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
More information is needed. Does she have the equivalent of a bachelor degree? Can the employer insist in good faith that the job requires an employee with a minimum of a bachelor degree? Also, that she has specialized skills that the employer needs? Filing for an H1b visa is expensive in that the USCIS charges fees in excess of $2000. She should retain a competent and experienced immigration and visa attorney assist the employer. It is unclear whether she or the job will be enough for visa approval. Also, the employer may have to wait until October for her to start, since work visas for her line of work may be unavailable.
