It depends on the exact criminal charge, but if it is a misdemeanor or the charges dropped/dismissed or if he qualifies for a waiver of that ground of inadmissibility, then he should be able to get his green card. How is he applying if he has been here illegally for so long?

Your application for permanent residency cannot be denied based on the fact that you are pregnant and unmarried. If you are currently outside the US, you will need to complete you medical exam and schedule and attend your ASC appointment before the interview.

As long as you didn't overstay the term of the permit, you should be okay to revisit. If there is a problem it likely won't be because of the Visa but because of security.
