If adjustment of status is denied, not through DACA, will I be deported or will be safe because of DACA?

As long as you remain in valid immigration status, such as DACA, and USCIS is aware of that fact, they will not place you in removal proceedings if your I-485 application is denied. Normally, USCIS will approve your I-485 application if your I-360 has also been approved, unless you are inadmissible to the US for having violated certain immigration rules, such as a conviction(s) for a crime(s) of moral turpitude, making a false claim to US citizenship, membership in terrorist organizations, etc.

What are the options to stay in US? I have a green card, and I getting divorce with my US citizen wife.

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. You can petition to remove the conditions on your status without your wife.  However, you must show strong proof that the marriage was real from the beginning until separation. If she is pregnant with your child, you will have strong proof. But, you must show additional documentation as well. Let me know if you would like to discuss in more detail.

Divorce before the first interview

Yes, your case will be denied and you will need to leave the US(unless you still have some temporary visa status that is valid).  There is an exception if there was spousal abuse.
