Can I marry and apply for adjustment of status during the grace period of my J1 visa or would I have problems with my case?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
More information is needed. Are you subject to the 2 year residency requirement? Perhaps, there are other reasons why you may be disqualified from adjustment of status, even if you marry a U. S. Citizen. I strongly recommend an appointment with a competent and experienced immigration law firm like our office before you file.

International Student- Using TPS work permit to do paid summer internship, is it okay to do?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If your brother is an international student holding valid status as a student, his work under a TPS work permit would be violative of his student status even if authorized by U.S.C.I.S. in my opinion.  He could have another option to perhaps obtain curriculum practical training from the institution to work in his paid internship as you say that it is related to his schooling. I encourage him to discuss the matter with the designated school official (DSO). Will USCIS deny my case?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)

By operation of law your mother's petition for is revoked upon your marriage. You should have waited to marry after your mother became USC. She will have to file new petition with new priority date.
