I am a US citizen filing i130 for my mom and step dad. They got married before I turned 18. In both petitions do I put my stepdad as parent 2?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
You need to file separate cases for each parent. Consider hiring an immigration attorney. Some of us charge an affordable flat fee to handle the cases from start to finish.

Can I file for my new husband if UNCIS issued the wrong green card as the marriage was over 2 years?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
A conditional green card is issued by USCIS if the qualifying marriage was less than 2 years old when you were granted permanent residency. If a conditional green card was issued to you in error, you will need to contact USCIS to correct the mistake before petitioning for your new husband. Otherwise, your record will reflect that you were a conditional permanent resident and failed to file a petition to remove the conditions before your status expired.

Will this warrants affect him in renewing his green card which already expired a week ago and can he still apply for citizenship?

He needs to take care of those warrants immediately and see an experienced immigration attorney to renew his green card, and if possible, apply for citizenship.
