You must file a petition with the USCIS along with evidence of the relationship. You must have visited your finance at least once in the last 2 years. You must demonstrate that she will not be a public charge and that she doesn't have a contagious disease. The process takes about 6-9 months from beginning to the end. Hello: He can try to file for a B-2 Visitor Visa. *B2 Visitor Visa Application* A Visitor Visa will have to be obtained. My firm prepares the application and then sends it directly to the applicant who will then take it to the U.S. Consulate or Embassy for a decision. If done correctly, the issuance of this visa could take less than one month after it is completed.

There is a law that says if you have been out of status for more than a year, and then you leave the USA, you cannot come back for ten years, unless you have advance parole or a green card. An approved I-130 and an approved DACA and a work permit card, is not a green card and is not advance parole. No DACA recipient should leave the USA without an advance parole document.
