How long do I have to wait to apply for my second husband to get his papers?

Answered by attorney Francis John Cowhig (Unclaimed Profile)

If your divorce is finalized, which I am assuming it is, you can apply for you second husband immediately. You will, however, need to show the U.S.C.I.S. your final divorce decree. The U.S.C.I.S. may question your first husband's and present husband's marriage and you may need documentation showing that both marriages were bona-fide and not merely for immigration purposes. I strongly suggest that you consult with an experienced immigration attorney in Chicago to advise you and guide you through the process.

Is illegal work and unauthorized stay forgiven, if a US citizen applies for their parent in the US?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, if a foreign national parent entered the U.S. lawfully and with inspection, his U.S. citizen adult child successfully may petition for him to adjust status to become a Lawful Permanent Resident (to get a "Green Card") regardless of whether he may have worked without authorization and regardless of whether he may have overstayed his initial authorized stay. If the parent entered the U.S. unlawfully and without inspection, however, then a more complex analysis is needed in order to determine eligibility. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

How long shouldn't I get married after getting a green card?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
There is no requirement for you to wait. However, more information is needed. What are your concerns? Did you obtain your green card through marriage to US citizen? Is this a former husband or boyfriend? A bit more information is needed before this question can be answered as a matter of legal advice.
