You will be considered to not be complying with the terms of your visa once your employment is terminated. At that time, you have a "reasonable time" to leave the United States. As long as your I-94 is valid, then you will not accrue unlawful presence and will not trigger a bar to reentry when you leave the United States. You can invest in a new business and apply for your own E-2. You are running out of time to find an employer and apply for an H-1B as the cap will be reached by next week and time is running short on being able to get the LCA filed on time. If you are from Canada, Mexico, or Australia, you may have other options.

As long as you are still married to your spouse in the Philippines you cannot marry anyone in the U.S. You have to wait until your marriage in the Philippines is officially dissolved before marrying again and then your new partner can petition for you.
