Understand best strategy to convert from F1 OPT to H4 EAD or H1B Lottery

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Your wife would know by early June whether she has been selected in the H-1B lottery. Since her STEM OPT is expiring in August, that would give her plenty of time to apply for H-4 status before the OPT expires. I do note that the Trump administration is attempting to undo the right to EAD for certain H-4 individuals, and hopefully such would still be available at the time of your wife’s application. Under the circumstances, I do not see a problem with the last action rule. Am I still eligible for intra-company transfer Visa L1?

default-avatar
Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
If your last employment as an executive or specialized knowledge employee was mid 2009, your last "year" of experience started mid 2008. If your employer files now, August 2011, the furthest back they can go is August 2008. Do you have 1 year of experience with the company since August 2008? That is your answer. Please note that your qualifying experience is falling off with each passing day. If this is not clear, check with company immigration counsel.

Your mother should petition her husband if she has legal status. You cannot petition your step father unless you have been adopted by him. See an immigration lawyer for help.
