How long can I stay in the US with a b2 visa if I have 6 months on my i94?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)

Usually, the more often that you try to enter the United States the less likely that immigration will allow you in, because they will begin to suspect that you have the intention to stay in the US permanently, unless you can prove to their satisfaction that you have a legal and valid reason to enter and that you will return after your authorized stay.

Yes. A mother who is a green card holder can petition for her unmarried daughter over the age of 21. It will take approximately 8 years before the daughter will be eligible to apply for an immigrant visa.

My gf is here on a K1 visa..Can we take a short trip to mexico and come back?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The K-1 entry is only for one entry and for 90 days. You would not be allowed to take a short trip to Mexico and come back. The proper way would be for you to be married, have her apply for her adjustment of status to permanent residence, and at the same time apply for advance parole to travel outside the US during the time that the adjustment of status application is pending. It usually takes 90 days from the date of submission for an advance parole application to be approved.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
