Hello, Yes, you can file for her son also. If you file now that he is under 21 years old it will be much faster. You can petition from China so that her son's application gets started now as he is 20 years old. It is important to speak to an experienced immigration lawyer so that you can make certain you file at the right time to avoid any lengthy separation with your wife's son. Good Luck.   Disclaimer: This information is of a general nature and is not, nor is it intended to be legal advice. If my spouse is multiple b1/b2 how do I convert to green card of citizenship?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, a U.S. Citizen parent of a married daughter may petition for her in the Family-based Third Preference visa category. Note, however that there is a multi-year backlog for visas in this category, and the married daughter would not be permitted to stay in the U.S. on a visitor's visa (B1/B2) while waiting for a visa to become available. Other eligibilities and options may exist, and there is no substitute for engaging an immigration attorney to review all of the relevant facts in order to advise about eligibilities, options and strategies. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Your USC wife can file an I-130 petition for you and you can file an I-485 application to adjust status at the same time. You should consult an immigration attorney as there are many other forms and documents required.
