If I just got my green card when I migrated with my 5 kids as single, how soon can I go back to Philippines to marry and petition?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
If you already have a green card, you can immediately return to the Philippines to marry your children's father. However, it will take approximately 2 years to process the paperwork before he will be able to immigrate to the US. The petition is filed on form I-130.

I am a US citizen and my parents are in Nicaragua; can I go to the US Embassy in Nicaragua to get them visas?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
You can help them apply for tourist visas. However, if you are trying to immigrate them to the US, you will need to file their separate cases in the US first. Then, the case will be forwarded to the Embassy.

Your employer can petition for a change of status from B1/B2 to H-1B as long as you remain in status when the petition is submitted. The earliest that the petition can be submitted is April 1st of each year, and the earliest date that you can start working is in October of the same year. The petition is submitted on form I-129.
