That will depend on your age. If you are under 21 under CSPA by the time your mother's priority date is current, you can be included in the application. Since this type of immigration will take more than 12 years, it is unlikely that you would be still under 21 given the fact you are an F1 student now.

The question for an immigration inspector is whether your mother-in-law is able to show that her stay is temporary as she is here under a visitor visa. Trying to make a quick return to the US after being here for six months might cause a problem at the port of entry. You should definitely speak with an immigration attorney and bring the court documents to the appointment. Is it first degree assault? Is that just the charge? Did he plead to something else? What was the sentence? Assaults can be construed as crimes involving moral turpitude, and he may need a waiver of inadmissibility. It would be unwise to proceed without an immigration attorney.
