Can I apply for a B1 then change it to F1 before I start university?

Answered by attorney Alena Shautsova

You should have a consultation with a US immigration attorney. You can have one via Skype. It is not possible to answer your question regarding the O visa as there is no information in your question allowing to make a conclusion that you are eligible for an O visa. As for the change of status from B visa to F, it is possible, but only if one does not have plans to study when he/she enters the US.

If I filed a I-130 Petition while parent is in USA, can she stay here while waiting for petition to get processed?

You should have filed the I-130 with the I-485 together. Then she would be allowed to stay. Now you can wait for the I-130 to be approved but that can take almost a year. I would probably file for the green card and have her stay. Future visits on a tourist visa can be problematic when she is in the process of getting a green card.

What will happen if we did not show up in our interview?

Most likely your petition will be denied for failing to appear at the interview. USCIS can also deem your petition to be abandoned.
