When is the latest we can wait to file if I am within the 5th month of my first H1B?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
In general, it is never too early to start the green card process. We generally recommend to our clients that they commence the green card process by not later than the middle of the fourth year when they have the H1B visa in order that they can take advantage of the extensions that are available under the American competitiveness in the 21st-century act. If you wait until the beginning or middle of the fifth year of your H1B then there may be some issues depending upon the amount of time that you can recapture on your H1B visa. Please note that this information is not legal advice and is provided merely as a courtesy in response to your email question to our office. Hi. Unfortunately, if he was originally in the US illegally left and re-entered again illegally, he is permanently barred from processing for 10 years.

Hello, i need to know if my husband filing for unemployment benefits will affect my I-485 petition if i already have a co-sponsor

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
If your husband does not meet the minimum threshold in income to qualify as your financial sponsor, then he must find a joint sponsor who can do that. Good luck.
