What can I do if my visa waiver was denied?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
Generally speaking, you can file again if you have new evidence of the hardship. What evidence did you submit in support of the waiver? Please note that the hardship must be to you or other US nationals, not your husband. What consulate did he apply at? Please review this information for more details about the waiver requirements. Thank you.

Can I marry a Guatemalan woman with a child and bring them both to the United States?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
There are a few different ways to do this. If you would like guidance with regard to a matter of this type, please give us a call and we would be more than happy to assist you. In general, you will need to do a filing for your wife and for your step child and then do you consular processing for them in Guatemala. Since this type of process is riddled with many nuances, we definitely suggest that you consider engaging qualified immigration counsel for such matters.

Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
It is difficult to give effective legal advice when there is so little known about the individual. She and you (or you if you know the facts of her case and she is still detained) would best be advised to make an appointment with an immigration lawyer who can explore her situation and go over any options or reliefs.
