Dear Veronica, If he was charged with drug trafficking or conspiracy, this is an aggravated felony for immigration purposes and is a very serious charge.  If this is the case, more than likely he will be deported. The best thing you can do right now is obtain a CERTIFIED record of conviction from the court (Court Minutes) so that an attorney may properly analyze the immigration consequence of the crime.   Evelyne M. Yes. You can apply for your parents as long as they last entered the US legally (even if they overstayed). The process takes about 8 months from start to finish. There is no penalty for the overstay and most parent cases get approved without any interview.
