Can my mother get residency when I turn 21?

default-avatar
Answered by attorney Ross Elliott Miller (Unclaimed Profile)
Immigration lawyer at Miller Conway
You will not be able to "fix" your mothers papers as she has no papers (due to her illegal entry into the United States). That said, your mother's status as a victim of abuse may allow her to adjust status based on a U-Visa (this will depend heavily on the circumstances and status of the case). Please contact an immigration attorney to discuss this matter further.

I have an active felony warrant and have to go back to Europe for work before I can get this taken care of.

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Unless the authorities are following you, you shouldn't be arrested at the airport.  Neither the airlines nor TSA run criminal background checks before allowing you to fly, so no one at the airport will know of the outstanding warrant.  Of course, you could hire an attorney to represent you and that may help avoid additional charges such as being a fugitive for leaving the US with an outstanding warrant.

Can a mother who becomes a US citizen file a petition for her married sons, who are above 21 years?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Yes. A US citizen mother can petition for her married sons and daughters regardless of their age. It's currently taking about 10 years from the date of filing or the priority date before a visa number will become available.
