My Italian fried is marrying a US citizen; if she then wants to divorce will she lose her green card?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
If the marriage is entered into for legitimate reasons and there is a divorce she can argue that the adjustment should be allowed. If she is marrying to get the Green Card she will be involved in a fraud and will have serious problems.

How long will the NVC take ?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As the F-2A category for spouses of permanent residence is available for immigrant visa issuance where the I-130 petition was filed by September 8, 2013, your case is current and should be processed fairly quickly. In answer to your questions, the next steps after the payment of the invoices will be the NVC's instructing you and your husband to prepare documents including affidavit of support papers and send them to the NVC. If everything is all right, an interview could be scheduled within two – six months of sending in the documentation. Your husband will be interviewed at the location which is indicated for consular processing on the I-130 form. If your husband wishes a change of location, he should notify the NVC.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What should I do if I'm not certain I handled my I-485 paperwork properly?

At this point I suggest to wait and see if you receive any request for additional information regarding this issue via RFE or during your interview by an officer. If so, then you can simply state the truth which was an error on your part. You can obtain something from your Aunt/Aunt's business that you did some voluntary work to learn and you did not get paid!
