What are the ways I can have a green card so I can be with my family?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
The simplest solution is to marry the mother of your child so that she could file an immediate relative petition for you. Whether you have other means of obtaining a long-term status in the U.S. depends on your education, professional credentials, and availability of a U.S. employer who would sponsor you; without this information, there cannot be a meaningful discussion of your options. However, one point is certain: any other solution that might exist will be costlier, time-consuming, and less likely to succeed.

Can I get married if I’m from Haiti and I have a tourist visa for the US?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A Haitian visitor may marry a U.S. Permanent Resident, but that will not automatically create any authorization for the Haitian spouse to remain in or work in the U.S. Analysis of immigration options for the Haitian spouse will depend upon many details not included in your question. It would be wise for you and your fiance to consult with an immigration attorney who, after learning all of the relevant information about you, your immigration-related history, your fianc? and your goals, will be able to advise about immigration eligibilities, options and strategies.

What level of income, if any, must I show, for my Green Card holding wife to qualify for Naturalizaton?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Level of income is not a requirement for a naturalization application. Tax returns are required for naturalization interviews not for the level of income earned per se, but to determine other factors such as whether persons are paying taxes on the money that they earn, whether joint returns are being filed where the applicant received the green card through marriage to a US citizen or permanent resident, or if the applicant worked with the sponsoring employer after obtaining the green card, etc. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
