Can an 18 year old marry a 30 year old? Can I bring his mom to visit?

Answered by attorney Olesia Gorinshteyn
Immigration lawyer at Gorinshteyn Global, LLC
You can marry whoever you want to. Unfortunately, you cannot bring his mother here to visit. You may invite her but she would have to file her formal application with U.S. Embassy.

Can I get fiance visa for my wife?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You cannot get a fiance visa (K-1) for your wife. Once you are married she is not eligible for a fiance visa. You must file and I-130 Petition for her. While you can also file and I-129F Petition to start the K-3 process after you file the I-130 petition, it will not speed up the process. The USCIS is taking just as long to process K-3 petitions as I-130 petitions for spouses.

Could my wife apply for USC now?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Your wife twice failed in her attempts to pursue the naturalization process on her own and without a lawyer; becoming a naturalized citizen is very important to her career; and you are asking whether she should consult with an attorney? Your wife's failure to identify a child was the type of error that could have been avoided had she worked with a skilled immigration attorney from the beginning. Now there appears a presumption that she committed the very serious offense of fraud in an immigration-related application. Her situation is complex, and significantly more information will be needed in order to determine whether a solution may be possible through application for a waiver or otherwise. The same is true even for a determination of whether her inaccurate sworn statement that she did not have that child may interfere with her ability to maintain Permanent Resident status. It would be quite unwise for your wife to continue to address the frequently very complex immigration legal issues she faces without working with an immigration attorney.
