What does refusal under section 217 10000 mean and how does it affect future applications under ESTA?Thanks

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I am not sure what 217 10000 means, but the usual advice in situations like yours would be to apply for a student visa directly at the American consulate or embassy, and explain your refusal under ESTA at the visa interview. Please note that you cannot make an application for change of status from ESTA to student.  Due to the limitations of the Lawyers.com Forums, Alan Lee & Arthur Lee, Esqs.’ (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can I ask immigration to let me go back or can my son ask for me?

Alan Rodolfo Diamante

Your story is confusing. Why would you sign voluntary deportation? What do you have on your criminal record is the main question you need to answer before an attorney can answer your question.

If I take myself out of the food stamps and just leave my children, can I be a sponsor for my husband with the help of someone else?

You must file Form I-864 Affidavit of Support even if you have no income at all. Since your income is less than the federal poverty guideline, you need to find a co-sponsor who will file an I-864 Affidavit of Support for your husband. The co-sponsor does not have to be your or your husband's relative, but must be a U.S. citizen or permanent resident who has enough income to qualify under the federal poverty guidelines. T
