You need to know if you were convicted of any crime and if yes, when and what. "dismissal" of charges may not mean you were not convicted. Sometimes a court would dismiss a case after a defendant completes the sentence/probation.

You can petition him now and then once you become a U.S. Citizen you can upgrade the petition to immediate relative of a U.S. Citizen. To be safe, I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is presented so as not to delay the process.
