How long does form I-130 for wife and 1 month old daughter be fixed?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
Since the quota takes about 3 years, the CIS gives such petitions a low priority. Surely, they would normally finish the I-130 adjudication at least a few months, if not a year, before the quota date is reached.

What can my green card holder mom do to help me..? I am in USA on a visiting visa,

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hi. Your mother can file for you, but it will not provide any immediate immigration benefits. It will not give you the right to stay here while it processes. That is only possible if she were a citizen.  If you overstay and leave you may be subject to different bars from returning. She would need to naturalize before you turn 21 to process now and stay.

Can my step mother petition me to adjust my status without me getting affected by what my father did?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The situation with your father will likely affect the adjudication of your stepmother's petition for you. The step relationship depends upon the bona fide nature of the marriage of your father to your stepmother. The US government would have to be certain of the bona fides of that relationship before granting you residence status based upon it.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
