Having a lawyer is always a good idea.  Step mothers cannot confer any immigration benefit.  If you are in removal proceedings, the underling status qualifying you for a work permit is being called into question, so the work permit won't protect you.

A K-1 visa is unlikely to be issued, a K-3 with a waiver is the better option. The approval of the waiver will depend on a hardship to a US citizen relative, you. As a fiance, you are not related and therefore there is no hardship to a qualifying relative.

Yes, you must disclose the arrest. Even if the case was eventually dismissed, the answer is still yes because the question also asks about arrests. Make sure you put in an explanation that the case was dismissed because 'no offense was in fact committed' and 'no probable cause' was found. Obtain certified copies of court records and court clearance to present to the consular officer during interview.
