As a US citizen applying for a married son or daughter, your case falls under the F-3 category which currently has a backlog date of December 15, 2007 for the month of March 2020 for natives of all countries except for Mexico and the Philippines which must wait longer. Assuming that you are not born in Mexico or the Philippines, the waiting time is approximately 12 years at present. Can my son attend high school in the US without having a F-1 visa?

Reza Athari
Answered by attorney Reza Athari (Unclaimed Profile)
Immigration lawyer at Reza Athari & Associates, PLLC
If you became a permanent resident based on marriage, your wife can file a petition for your son. Be aware, a visitor may not attend school in the US. He will need a student visa. Some private schools issue I-20.

My husband got convicted and deported. Is there any possible way he can come back to the united states?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
In the circumstances that you described, it is difficult for me to see that your husband would ever come back to the United States legally. A crime involving manufacturing and delivery of drugs (I assume that it is drugs) and a sentence of 10 years is an aggravated felony. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
