Can I apply for a green card for my stepfather?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
Did your parents get married before you were 18? You need to speak with an Immigration attorney to check eligibility, but generally speaking a stepchild can sponsor a stepparent if certain conditions are met.

If B2 visa holder married a US citizen, how long does it take to get green card and can I continue to stay when my visa expired?

Although someone on a B2 visa can typically adjust status if he or she gets married to a U.S. citizen, there are many things to consider before proceeding such as whether the intending immigrant has any grounds of inadmissibility that might prevent him/her from adjusting status. It typically takes six to nine months, however it could take longer. There are no guarantees. I would suggest you work with an experienced immigration attorney to guide you through this process. One mistake on your part could be costly.

We"re holding k1visa but petioner's seriously illness i can't hold a wedding whatI'm going to do to legaly to live here

Answered by attorney Harun Kazmi

Hi. You cannot change your status when on K1s and K2s. You must marry the petitioner and have him submit the application. If you overstay the K-1, I-94s, you can still process your green cards when he is feeling better. You will be out of status, but can still marry him and obtain your green cards. But, you will need to file additional applications for the green card.  If he is not going to get better, you  must leave the US to avoid additional violations and possible bars from returning if you overstay too long. Thank you.
