You are correct. If your priority is no longer current you cannot file for adjustment of status. If your petition was filed before April 1, 2001 you may be eligible to file for adjustment of status even after your H1B expires. However, you should check with an immigrant attorney to see if you qualify.

If he entered with papers of any sort, he can probably stay in the country while becoming legal. If he entered the US without papers, then it is almost certain that he will need to leave the country to become legal. There are rare exceptions to this, so if he did enter without papers you should consult an immigration attorney to fully understand all possible options.

If you are a US citizen and your fiancé entered the country legally, then after you marry him you can file to adjust his status to lawful permanent residency. If you do not live together after marriage that may be a problem when you apply. IF you aren’t working then you would need to have someone file as your joint financial sponsor. Lastly it makes no difference to the geeen card application if your parents disapprove of your marital decisions.
