My fiancé visa is about to expire, I got married here in the US but failed to adjust my status. Am I going to get deported?

Please contact an immigration attorney. You have rights under immigration law especially because your marriage seems bona-fide in that you have a child with your husband. You could apply for legal status either through your husband, and/or on your own depending on your relationship.

Would having a class c misdemeanor affect applying for a job permit under obama''s new plan? It was a minor in possession of alcohol

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
A Class C misdemeanor for being a minor in possession of alcohol would not affect your application for a job permit under the Deferred Action for Childhood Arrivals program as long as it was not connected with operating a vehicle at the same time. It would count as a non-significant misdemeanor of which you would have to have three to endanger your successful participation in the program. Can I stay and work in USA with an active I94 but with an expired L1B visa?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
No problem and no issue whatsoever. A visa only deals with the right to apply to enter the USA. The ability to stay is controlled by the I-94 card. Some people have a 10 year visa and mistakenly believe they can stay here for 10 years.
