I strongly suggest you sit down for a free consultation with a new attorney and bring documentation for review. It is not clear what the fees are for and your current attorney may not be accurate if he or she is saying you cannot get the information from your uncle's checking account. Doesn't hurt to get a second opinion.

If her estate is under $150,000 and it has been more than 40 days, you should be able to do a small estate affidavit to get access to the account. If over $150,000 you will have to get Letters from a court by filing probate.
