What do I do if my mother has passed without signing over a power of attorney?

A power of attorney is no longer valid once the person who signed the power has died. Even if your mother had signed a power of attorney, then, it would not help you now. It's not possible to tell you what to do now, without receiving more information. You may have to probate your mother's estate, or there may be a way around probate. The question depends mostly on the size of your mother's estate. You can do some reading on the subject of probate, you can talk to a lawyer who handles probate matters, or both.

If he left a will or a trust naming you as beneficiary, you would be entitled to receive from his estate as he designated (whether or not you were married). If he had no such paperwork and you were not married, then you are not entitled to receive from his estate; however, if you had jointly titled assets (e.g. a house or bank account), you may be entitled to receive his share of those assets (it depends on how the title was held). I recommend you consult with an attorney to discuss this matter in greater detail.

Talk to your attorney. This should be an ongoing conversation. If you are not clear on your responsibilities, which can vary from case to case, then you should ask your attorney for more information. The Judge will not send you anything about your duties. Discuss with your attorney how your compensation should be computed. Generally speaking, I advise my administrator clients to keep a log of their time and what they did for the estate.
