Hello, The life insurance is not subject to creditor claims. The creditors can make claims against the estate, if there is one. It sounds like there will not be one, in your case.

If sister-in-law never presents the will to the court to probate it, then it doesn't do anything and it can say what it wants. In order to be effective to transfer anything, the will has to be brought into court. It is much more likely that sister-in-law will use joint ownership of assets, and not a will, to bypass this process. If you suspect foul play, get a lawyer started on this.

If your father had a will, you need to bring it to the attention of the probate court where he died. If he did not have a will, you will likely need to handle his estate through a process known as administration. Because you mention undue influence and breach of fiduciary duty, I assume your father had a will in place. But I could be in error. In any case, please contact an estate planning attorney as soon as possible to prevent further waste of your father's estate assets.
