Is it necessary to have an attorney to do last will and testament?

If you live in Michigan, check with your legislator and ask about Michigan's statutory will - he or she should be happy to provide the form to you. That said, a one size fits all form does not necessarily accomplish all that a person will want to accomplish in an estate plan - and a will is only one part of a proper estate plan.

Do I have to sign anything at all?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
You do not have to sign anything but generally, unless the property goes through probate, the property cannot be distributed to anyone anyway.

Should my husband and I get separate attorneys to do our wills?

Answered by attorney Irwin G. Klein (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Hein, Waters and Klein
That was suggested because sometimes there's a conflict between the husband and wife, making it ethically improper for the same attorney to represent both. However, it all depends upon your particular set of facts and circumstances and your individual wishes as to the preferred estate plan. You and your husband should consult with an estate planning attorney to get the answer now that the financial advisors made the suggestion.
