What do I do if I disagree with being the sole beneficiary of my mothers estate?

The Will governs the distribution of the estate; there are a couple of things you can do. 1. Accept the estate and give your sisters their share but this may have tax consequences. Consult with an attorney. 2. You sisters can file a friendly challenge to the probate and you can all stipulate to a settlement, which has the advantage of being an estate distribution, not a gift from you to your sisters. More time and expense in the probate, lower likelihood of adverse tax situation.

Yes, if an estate needs to be opened. Often, it does not. Whether it does in your case depends on whether or not there were assets titled in the father's name alone. This is relatively unusual. If there is a Will, it provides for the order of priority in acting as PR. If there is no Will, then State law does so.

When I die, will my wife inherit what property we now own together?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
This is why you need an estate planning attorney.  Paying a little money up front can ensure that your home and other assets pass the way you want.  You may think that you have a simple question, easily answered for free, but no one can answer it without seeing the deed.
