The short answer is no. The executor of an estate has a legal obligation to collect all of the decedent's assets, pay off all of the bills and taxes, and then distribute the remaining assets to the heirs. If there are not enough unbequeathed assets available to pay off all of the expenses, the executor must use the bequeathed assets. This would include your mother's checking account. Wait until the estate is settled and see what, if anything, is left in the bank account.

You will have to sit down with an attorney and all of the documents to figure this out. The issue is not what the assessor's office records say, but what deeds were signed and/or recorded, and what your grandfather's will and trust say.

You should have gotten a copy of the Final Account, which would set forth how costs were paid, it would include an Affidavit of Attorney Fees showing the lawyer's bills all the detail you're looking for. If not, go to the court and ask to see the probate file on the estate. It will all be in there.
